General
The General Terms and Conditions apply to all services to be performed (language coaching/translations/proofreading/terminology, hereinafter referred to as "order"). The contractor is "AcrossTheCultures". AcrossTheCultures reserves the right to make changes to the GTCs and the privacy policy.
Data protection
AcrossTheCultures processes all personal data with the utmost care and in accordance with Swiss data protection regulations.
Place of jurisdiction
The place of payment and jurisdiction is Basel-Stadt.

Language Coaching
Trial lessons
A trial lesson is free of charge and without obligation.
Registration
Registration is legally binding and requires payment for the selected package. Non-payment of the course fees does not constitute a cancellation of the course.
Invoice
Course participants will receive an invoice after registration. This must be paid within 30 days. In the event of late payment, AcrossTheCultures reserves the right to issue reminders for outstanding course fees and to charge reminder fees. Any collection costs shall be borne by the course participants.
Cancellation
Cancellation is only possible up to 24 hours before the course begins. From that point onward, and once the course has started, cancellation is no longer possible, meaning the full course fee is due. Unattended lessons will not be refunded, but can be made up.
Course exclusion
AcrossTheCultures reserves the right to exclude participants from a course for justified reasons. The full course fee is due in the following cases: exclusion from the course due to non-payment of the course fees and in serious cases, such as defamation, deliberate property damage, harassment, etc.
Translations/Proofreading/Terminology
General
Translations and proofreading are carried out exclusively by experienced translators who translate into their native language.

Conclusion of the contract
Unless otherwise agreed between the client (hereinafter referred to as the "Client") and AcrossTheCultures, the contract is only concluded when AcrossTheCultures confirms the order in writing (including by e-mail).
Intended purpose of the orders
When submitting documents to be processed, the Client provides instructions regarding the desired service (translation/proofreading/terminology), the execution, and the delivery of the order. Different services can be requested as part of the same order. Translations are charged per line, while proofreading and terminology are billed at an hourly rate (see Prices).
AcrossTheCultures undertakes to deliver the order to a professional standard corresponding to that of the original document(s). However, AcrossTheCultures cannot be obligated to meet any subjective style preferences of the Client.
The original documents supplied to AcrossTheCultures serve as the basis for translation and proofreading. AcrossTheCultures cannot accept any liability for errors resulting from ambiguities, poor legibility or incompleteness of the original document(s).
AcrossTheCultures does not format PDF documents. Translations or proofreading orders intended for publication must be submitted to AcrossTheCultures for review before printing; otherwise, AcrossTheCultures accepts no liability.
Quotes/Invoicing/Payments
Quotes issued by AcrossTheCultures are binding unless otherwise agreed (e.g., indicative quotes).
AcrossTheCultures will invoice completed orders based on the translated/proofread texts or terminology projects and the prices valid at that time.
Invoices must be paid within 10 days of being issued.
The copyrights to the completed orders remain the property of AcrossTheCultures until payment is received.
Delivery dates
AcrossTheCultures will carry out the order according to the Client's instructions and maintain the highest quality standards within the agreed delivery deadlines.
The delivery period specified in the quote refers to working days only. If orders are placed outside office hours (Monday to Friday, 08:00-17:00) or on a public holiday in the Canton of Basel-Stadt, the delivery period begins on the next working day.
Short delivery times can only be guaranteed after consultation, with AcrossTheCultures reserving the right to charge an express surcharge and/or stipulate a quality reservation due to the time constraints.
Translation, proofreading and terminology orders will be delivered by e-mail, unless AcrossTheCultures receives and delivers the orders through a web-based system.
If delivery is delayed (e.g., due to a power failure, disruption of electronic transmission, etc.), delivery shall be made as soon as possible or an alternate method of transmission shall be agreed upon. This shall not entitle the Client to waive the subsequent delivery or to make deductions from the payment. If delivery becomes impossible (e.g., due to force majeure), the Client and AcrossTheCultures are entitled to withdraw from the contract. In any case, the Client is obligated to pay for work already completed. Cases in which even partial delivery has become useless for the Client remain reserved.
Duty of care and confidentiality
AcrossTheCultures undertakes to handle all customer documents with care and to maintain the highest level of discretion.
Storage of documents
AcrossTheCultures is only responsible for the Client's original document(s) for as long as they are in its possession.
Cancellation
If an order is cancelled by the Client, the costs incurred up to that point in time must be reimbursed proportionally based on the level of completion of the order. However, the reimbursement claim will amount to at least 50% of the order value in any case. The right to charge for work that has already been delivered remains reserved.
Complaints
AcrossTheCultures guarantees services of optimal quality. If a service does not correspond to the agreed scope of services, the Client may report the defect, accompanied by precise information and examples. Complaints must be submitted to AcrossTheCultures within 5 days of the delivery of the order. The Client has the right to a correction by AcrossTheCultures within a reasonable timeframe.
A claim for correction shall be excluded if the defect was caused by the Client, e.g., due to incorrect or incomplete information, or defective original texts.
Liability
As permitted by law, AcrossTheCultures does not accept any liability for damage or loss as the result of incidental or ordinary negligence. AcrossTheCultures does not accept liability – to the extent permitted by law – for direct, indirect or consequential damage.
The General Terms and Conditions are available in German, French and English. In the case of discrepancies between the German and English versions, the German version shall take precedence.
